Introduction and Scope

In our mission to empower businesses through technology at Paywalex Software and Financial Technologies Private Limited (referred to as “Paywalex,” “We,” or “Us”), the provider of the Paywalex Platform and Services, we collect and use information about various individuals interacting with our platform.

This policy applies to: Merchants/Store Owners, Partners, End Customers, and Visitors of our corporate websites or those contacting support.

This Privacy Policy describes how we collect, use, disclose, and protect personal data. If we make any significant changes, we will notify you through the Paywalex administrative panel or by email.

1. Our Roles as Data Fiduciary and Data Processor (DPDP Act)

We define the roles and responsibilities for data handling under the Digital Personal Data Protection Act, 2023 (DPDP Act) as follows:

• Paywalex Platform acts as the Data Fiduciary for Merchant Data. This means we determine the purpose and means for processing Merchant Account Details (Name, email, billing, login credentials).

• The Merchant/Store Owner (You) acts as the Data Fiduciary for End Customer Data. You are responsible for this data, which includes End Customer Information (Name, address, purchase history, payment method details).

• The Paywalex Platform acts as the Data Processor for End Customer Data. We process and store End Customer data on behalf of the Merchant as per the Merchant's instructions.

2. Data We Collect, Why We Collect It, and How We Use It (Merchants and Partners)

We collect and use your Personal Data to fulfill our contractual obligations to you and deliver the Paywalex Services.

• Account & Identity Data: We collect your Legal name, Company name, Staff names/titles, Address, Email, Phone number, and Username. We use this data to create, verify, and maintain your account, and manage communications regarding the service.

• Financial & Compliance Data: We collect GSTIN, PAN, Bank account number for payouts, and Credit card details (for subscription). We use this data to process payments, issue invoices, and comply with Indian tax and KYC/AML requirements.

• Operational Data: We collect IP address, Browser/Device information, and Platform browsing activity (via cookies/logs). We use this data to ensure platform security, troubleshoot technical issues, and improve platform performance.

3. End Customer Data: Our Role as Data Processor

This section applies to individuals (End Customers) who shop on a Paywalex-powered store.

Important Note: The Merchant is the Data Fiduciary and controls the End Customer data. Paywalex acts solely as a Data Processor on the Merchant’s behalf. For details on how your specific purchase data is used, you must review the Merchant’s separate Privacy Policy.

When you interact with a Merchant’s store, we automatically process the following categories of data on behalf of the Merchant:

• Profile & Contact Information: We process Name, Shipping Address, Email Address, and Phone Number. This allows the Merchant to fulfill your orders and provide customer support.

• Financial & Transaction Information: We process Order details, Products viewed/purchased, Transaction history, and payment token details. This is used to process the transaction, manage billing, and maintain tax/accounting records for the Merchant.

• Device & Activity Information: We process IP address, Browser type, Cookie IDs, and Browsing activity on the Merchant’s site. This is used to maintain security and prevent fraud on behalf of the Merchant.

4. Data Sharing and Disclosure

We only share your Personal Data with third parties under the following limited circumstances:

• Service Providers: With third-party vendors (cloud hosting, security, support) who assist us in providing the Services.

• Payment Gateways and Banks: With the specific payment gateway or bank you select to enable transaction processing and payouts for your store.

• Legal Compliance and Protection: To comply with any legal process, enforce our Terms, or respond to valid requests from Indian government bodies, law enforcement, or courts under the IT Act, 2000, and other applicable statutes.

• Business Transfers: In the event of a merger, acquisition, or sale of Paywalex assets.

5. Your Rights Over Your Information (Data Principal Rights)

As a Data Principal (User) in India, you have the following rights regarding the data Paywalex holds about you:

• Right of Access: The right to request a summary of the Personal Data Paywalex is processing about you.

• Right to Correction/Erasure: The right to request the correction of inaccurate data or the erasure of your data, subject to mandatory legal retention periods.

• Right to Grievance Redressal: If you have a concern about the processing of your data, you may raise a grievance with our designated officer.

6. Data Security, Retention, and Deletion Policy

• Security Measures: We implement reasonable technical, administrative, and physical security measures, including industry-standard encryption, to protect your Personal Data in compliance with the IT Act, 2000.

• Retention Period: We will retain your Personal Data for as long as necessary to fulfill the purposes for which we collected it and to comply with legal obligations.

• Merchant Data Retention (Post-Account Closure): If you close your store, we will retain your store information for a period of two (2) years before commencing the deletion or anonymization process, as required for compliance with mandatory Indian statutes related to tax, audit, and legal complaints.
